Terms of Service

Welcome to Treklist Travel Planner ("Treklist", the "Service"). By creating an account or using the Service, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
1. Your Account
You must provide accurate information when registering and keep your password secure. You are responsible for all activity under your account. You must be at least 13 years old to create an account.
2. Acceptable Use
You agree not to:
- Upload content that is illegal, hateful, harassing, or infringes someone else's rights.
- Submit spam, fake reviews, or misleading photos.
- Attempt to access another user's data without permission.
- Reverse-engineer, scrape, or overload the Service's APIs or infrastructure.
- Use the Service for any commercial purpose without our written permission.
User-submitted photos and reviews are reviewed by our moderators before being published. We reserve the right to remove any content that violates these Terms or is otherwise objectionable.
3. Content You Submit
You retain ownership of content you submit (photos, reviews, trip names, messages). By submitting content, you grant Treklist a worldwide, non-exclusive, royalty-free license to display, reproduce, and distribute that content within the Service for the purpose of operating and improving Treklist.
4. Travel Information and Affiliate Links
Treklist provides travel guides, destination information, and listings for tours, activities, and accommodation. This information is for general guidance only — always verify details (hours, prices, availability) before traveling.
Affiliate Disclosure: Treklist is a participant in affiliate programs with Agoda, Booking.com, Expedia, and Viator. Some links to hotels, tours, and activities on this site are affiliate links. If you book or purchase through these links, Treklist may earn a small commission at no additional cost to you. This helps us keep the app free to use. We only feature providers and properties we believe are relevant to your trip — the commission does not influence which listings we show or the order they appear in.
Your booking is made directly with the third-party provider (Agoda, Booking.com, Expedia, or Viator), not with Treklist. All pricing, availability, cancellation policies, and customer service are handled by the provider you book with.
5. Activity Recommendations and Assumption of Risk
Important — please read carefully.
Treklist is an information and inspiration service, not a travel agent, tour operator, activity provider, or licensed guide. Features such as Random Adventure, Sidequests, destination guides, trails, beaches, and activity listings suggest things you might do — they are not endorsements, certifications, or guarantees that any activity, location, or operator is safe, legal, suitable for you, or open at the time you visit.
Many activities shown in Treklist — including but not limited to scuba diving, rock climbing, hiking, surfing, ziplining, bungee jumping, skydiving, white-water rafting, canyoneering, ATV riding, jet skiing, parasailing, and swimming at beaches or natural bodies of water — carry inherent risks of serious injury or death, even when performed properly and under supervision. Other recommendations may take you into unfamiliar neighborhoods, remote areas, or environments with hazards you are not aware of.
By using Treklist, you acknowledge and agree that:
- You are solely responsible for your own safety, decisions, and conduct while traveling, including which activities to attempt, which locations to visit, and which operators to use.
- You will assess your own fitness, skill level, health, and the on-the-ground conditions before participating in any suggested activity, and you will not attempt anything beyond your ability or training.
- Treklist does not verify the safety, legality, licensing, insurance, or operational condition of any activity, trail, beach, venue, or third-party operator referenced in the app.
- You are responsible for complying with all local laws, regulations, permits, and access restrictions at your destination, including closures, weather warnings, and protected-area rules.
- For high-risk activities you should use qualified, licensed, and insured operators, follow their instructions, and use appropriate safety equipment.
- You voluntarily assume all risks associated with traveling to and participating in any activity or visiting any location referenced in Treklist, including risks of injury, death, illness, property loss, theft, and financial loss.
If you book a tour or activity through a third-party link (e.g. Viator), your participation is governed by the terms and safety policies of that operator and booking platform — not by Treklist.
6. Third-Party Services
The Service integrates data and content from third parties including Geoapify, Viator, Wikimedia/Wikipedia, and Google Firebase. Treklist is not responsible for the accuracy or availability of third-party data. Your interactions with third-party booking sites are governed by their own terms.
7. Treklist Pro Subscriptions and Billing
Treklist offers a paid subscription called "Treklist Pro" that unlocks additional features such as unlimited trips, offline access, itinerary export, and trip collaboration.
Pricing and Billing.
- Treklist Pro is offered as a monthly subscription ($4.99/month) or an annual subscription ($39.99/year). Prices are listed in USD and may be subject to local taxes depending on your location.
- Payment is processed securely by Stripe, our payment provider. Treklist does not store your credit card number, CVV, or other sensitive card details — those are handled entirely by Stripe.
- By subscribing, you authorize Treklist to charge the selected subscription fee to your payment method on a recurring basis until you cancel.
Auto-Renewal.
- Your subscription automatically renews at the end of each billing cycle (monthly or yearly) unless you cancel before the renewal date.
- You will be charged the same price you originally paid for each renewal, unless Treklist notifies you of a price change at least 30 days in advance.
Cancellation.
- You may cancel your subscription at any time through the Stripe customer portal (accessible from your Treklist profile) or by contacting treklisttravel@gmail.com.
- Cancellation stops future renewals — your subscription remains active until the end of the current billing period, and you retain Pro access through that date.
- No further charges will be made after the effective cancellation date.
Refunds.
- All subscription payments are final and non-refundable, except where required by applicable law.
- If you believe you were charged in error, contact treklisttravel@gmail.com within 30 days of the charge and we will review your request.
- Canceling a subscription does not entitle you to a refund of any prior payment for a billing period that has already been completed.
Price Changes.
- Treklist may change subscription prices for future billing periods. Any price change will be communicated to you at least 30 days before it takes effect.
- If you do not agree to the new price, you may cancel before the renewal date to avoid being charged the new amount.
Free Features.
- Treklist remains free to use without a Pro subscription. Free users have access to destination guides, search, trip planning (with limits), and social features.
- Treklist may adjust which features are available to free users or Pro subscribers at any time, with reasonable notice.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, secure, or that all information (including activity listings, trail conditions, beach access, opening hours, prices, or safety information) is accurate, current, or complete. Travel involves inherent risks — you are responsible for your own safety and decisions.
9. Limitation of Liability
To the maximum extent permitted by law, Treklist, its operators, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or reliance on any information, recommendation, or suggestion in the app — including but not limited to injury, death, property loss, theft, illness, financial loss, travel disruption, or any outcome resulting from participating in a suggested activity, visiting a suggested location, or booking a third-party service.
Treklist is not a party to any booking made through affiliate links. We are not responsible for the actions, availability, pricing, cancellations, refunds, service quality, or policies of any third-party booking platform (Agoda, Booking.com, Expedia, Viator) or accommodation, tour, or activity provider. Any dispute regarding a booking must be resolved directly with the provider. Prices, availability, and property details shown on Treklist are for informational purposes only and may change without notice — always confirm details on the booking platform before completing a reservation.
This limitation applies even if Treklist has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you in full.
10. Account Termination
You may delete your account at any time. We may suspend or terminate your account if you violate these Terms or engage in harmful behavior.
11. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws applicable in the jurisdiction where the Service operator resides, without regard to conflict-of-law provisions.
